We like to talk about life experiences every time we will and what we&#8217;re seeing in the short sale world. We had a situation just lately and it was our client, our seller and it is a very difficult short sale. Mainly they have not made a payment in a while and the bank on the second reached out to us. This financial institution has been contacting us very frequently truly for the last four or 5 months. So, it seemed like we had good communication going nevertheless, we&#8217;ve not gotten an offer. There are a variety of things that go into that, one being excessive HOA dues since it&#8217;s a condo. On top of that there was a special assessment which has essentially made the HOA dues equal to another mortgage payment.</p>
<p>The principle factor is that this lien holder called and said they wanted to hear from the seller. So, I called her and let her know that we had a contact that needed to hear from her right away. She called and they informed her it had already been turned over to the reclamation department and basically the financial institution is going to be taking it back. So her second is now not able to be negotiated at this point.</p>
<p>Now we have some techniques I think to get that out of recovery but I think we&#8217;ve got realized a lesson here. We&#8217;ve learned on seconds and home equity line of credits is if you&#8217;re contemplating a short sale, when you decide not to pay your 2nd mortgage or your home equity line of credit, please understand that after you&#8217;re 120 days out, they have an internal policy that they&#8217;ll then discharge that debt and then put it right into a restoration department or actually sell off that bad debt to a collections agency.</p>
<p>If in case you have determined to not make payments on a second or HELOC, maybe just be sure you are by no means more than a hundred and twenty days out. 			<content:encoded><![CDATA[<p>If you are selling your house without an agent and you have to be out of town for a while, do you know what to do? Years ago, I learned how to handle that situation when I&#8217;m selling my house. To show my property to interested buyers when I&#8217;m out of town I needed help that was set up in advance of my trip. I found out about a Limited Power of Attorney form which allows me to give a trusted person the legal right to show and even contract to sell my home in my absence. Since I learned about it, Limited Power of Attorney forms have worked well for me whenever I needed someone else to assist me in selling my property.</p>
<p> Now please remember that I am not a lawyer or any kind of expert in real estate law, but what I understand is that in most states a person has to be licensed to help someone else sell a house. There are exceptions of course, but whenever someone who is not the owner of a house gets involved in a transaction, that person is legally required to have a real estate license. To repeat, I&#8217;m not giving legal advice, I&#8217;m simply explaining one idea that has worked for me in the past for selling my house.</p>
<p> Ever since I learned about using a Limited Power of Attorney form, one that is properly drafted by my attorney who is, of course, licensed in my state, I have had good success with it. I sign the form to appoint a certain person who is named on the form, to represent me in the tasks involved in selling my house. It&#8217;s important that I choose a person I can absolutely trust, of course, and that choice is completely my responsibility.</p>
<p>Then, thereafter, he or she is called my &#8220;attorney in fact,&#8221; but that term has nothing to do with being an attorney; the only similarity is that both a licensed attorney and an attorney-in-fact can assist me regarding the sale of my property. This person, my attorney-in-fact is representing me only for certain very specific tasks when I <a target="_blank" href="http://www.18002sellhomes.com/pages/1721083/sell-my-home.aspx">sell my house</a>, and has no other legal rights or responsibilities for me at all.</p>
<p> Whenever my attorney-in-fact has dealings with buyers signing paperwork to buy my house, he or she can complete a sales contract for the buyer to sign, and then sign the ales contract on my behalf as well. This is a great advantage for sellers who may be unavailable to sign in person when the time comes.</p>

<p> So, I&#8217;m sharing three basic real estate terms in this article. These terms are good to know when you are selling your house. Naturally, you can find real estate websites full of legal and real estate industry terminology online, but I have to admit it&#8217;s easy to get overwhelmed visiting those websites. The truth is - all you really need to know is what&#8217;s relevant to you and to your own sale transaction. <p> And next, let&#8217;s look at the phrase &#8220;Exclusive Right To Sell Listing Agreement&#8221; -chances are, you will be signing one of these agreements to give your broker the right to collect a commission on the sale of your house. Then your broker splits his or her commission with the agents involved in your sale.</p>
<p> Finally, we have the term &#8220;Purchase Agreement,&#8221; &#8220;Sales Agreement&#8221; or &#8220;Sales Contract&#8221; - this is the form on which a buyer makes an offer to purchase your house. However, I see my relationship with my real estate agent differently than most homeowners, that&#8217;s probably fair to say when I try to sell my house.</p>
<p> Back when I was beginning to learn how to sell my house I starting out doing it like everybody else did it at the time, and hadn&#8217;t developed the understanding about my personal responsibility as a seller. What I mean is that I thought if I signed a listing agreement then the agent became completely responsible for the transaction immediately. Basically, I turned over all responsibility and attention to my agent and pursued other real estate deals. But, over time I realized that is not how to sell my house at all. And it is certainly not how to go about the process required to <a target="_blank" href="http://www.18002sellhomes.com/pages/1720826/sell-your-own-home-fast.aspx">sell your own home</a>.</p>
<p> It&#8217;s easy to find plenty of websites and lots of articles online as well as printed pamphlets describing the common traits that property sellers want to find in agents. They want agents who understand their needs, who are trustworthy, who bring qualified buyers and not just lookers to see the house, who do not pressure them to lower the price or sell to a particular buyer, who have good connections with buyers and other people in their industry, who are expert negotiators and who have careful attention on the details of all their listings every day.</p>
<p> I&#8217;ve noticed that some sellers desire a long history of sales success, as well, when they are contemplating hiring an agent. I&#8217;m not sure they that list always provides what a particular seller needs. Probably the thing I&#8217;ve learned about how to sell my house that is most important is that every seller has specific needs. An agent must be sensitive to the needs of each seller. Sellers, for example, selling a quaint cabin in the woods have very different needs than owners of a large horse-training property. While that&#8217;s just one example, it shows you what I mean by specific.</p>
<p> I hire real estate agents who allow me sell my house by owner without obligation to pay a real estate commission. This is not a common arrangement, but it is legal. I also hire agents who put my house on the MLS with the agreement that I can market my house myself, too. I discuss all these requirements with my prospective agents before hiring them to help me sell my house, and I am suggesting that you think carefully about your own needs as well. Take time to find the right agent for your own purposes, one who agrees to provide all the services, and only the services you want.</p>
